FERPA Direct Notice

Dear K–12 School,

​

As part of SEL DEVELO, Inc.’s (“SEL DEVELO”) compliance with the Family Educational Rights and Privacy Act (“FERPA”), we are required to provide this notice to each K–12 school (“School”) that uses the Growth Lab™ platform or any related SEL DEVELO products or services (“Services”). This notice explains how SEL DEVELO processes Student Education Records on behalf of your School.

When your School uses SEL DEVELO Services, SEL DEVELO acts as a School Official with a legitimate educational interest under FERPA. This means SEL DEVELO may receive, process, and maintain Student Education Records solely for the educational purposes your School authorizes.

SEL DEVELO does not use Student Education Records for advertising, commercialization, or any purpose unrelated to the Services. Your School retains ownership and control of all Student Education Records, and SEL DEVELO will only access or disclose such records at the direction of the School or as permitted by law.

School Authorization Under FERPA

By agreeing to our Terms of Service and using SEL DEVELO Services, the School designates SEL DEVELO as a School Official and authorizes SEL DEVELO to process Student Education Records for the School’s educational purposes.

SEL DEVELO will follow the School’s instructions regarding:

​

• access to Student Education Records

• correction or updates

• data retention

• secure deletion or export of Student Education Records

​

Parents maintain all rights granted under FERPA; however, because SEL DEVELO acts on behalf of the School, SEL DEVELO will always follow the School’s direction when responding to parent requests.

​

School Accounts vs. Family/Individual Accounts

SEL DEVELO supports two types of Child accounts:

​

• School-Managed Accounts: Created and managed by the School or teacher.
  FERPA applies. Students do not create accounts directly.

• Family / Individual Accounts: Created directly by a parent or guardian outside of a School relationship.
  FERPA does not apply; these accounts are governed by COPPA and SEL DEVELO’s Privacy Policy.

This Notice applies only to School-Managed Accounts, where the School controls Student Education Records.

​

Information SEL DEVELO Receives From the School

To support instruction and student use of the Services, the School may provide SEL DEVELO with:

​

• student names or identifiers

• classroom, grade level, or grouping information

• School-assigned student or classroom IDs

• teacher/classroom assignment

• School-managed or SSO login credentials

​

SEL DEVELO does not permit students to create School-Managed Accounts independently.

​

Information Collected Automatically

To maintain, secure, and support the platform, SEL DEVELO may automatically collect:

​

• device and browser information

• session duration and platform activity

• IP address or similar security identifiers

• feature usage, progress logs, and application events

​

This information is used solely for internal operations such as security, fraud prevention, analytics, and improving the Services.

​

Learning Activity Data

During use of the platform, SEL DEVELO may collect:

​

• lesson progress and completion

• activity responses

• XP, streaks, rewards, and achievements

• engagement metrics and performance indicators

​

When linked to an identifiable student, this information is considered a Student Education Record under FERPA.

SEL DEVELO does not collect biometric identifiers, precise geolocation, or other sensitive categories of personal information.

How SEL DEVELO Uses and Shares Student Education Records

Student Education Records are used only to:

​

• operate and maintain the Growth Lab™ platform

• support instruction, classroom management, and reporting

• provide teachers and Schools with student progress insights

• secure accounts and verify identity

​

SEL DEVELO shares Student Education Records only with:

​

1. Teachers and School Personnel — to support authorized educational purposes

2. Parents or Guardians — at the direction of the School

3. Service Providers (Subprocessors) — under written agreements that require strict confidentiality and security

4. Legal Authorities — when required by law, court order, or subpoena

5. Safety and Security Investigations — as permitted by FERPA to protect students or prevent threats

SEL DEVELO does not sell Student Education Records or share them with advertisers.

​

Data Retention and Deletion

SEL DEVELO retains Student Education Records only for as long as the School account is active or as required by law. Upon School request, SEL DEVELO will:

​

• securely delete Student Education Records

• export records to the School

• restrict or terminate access

​

All deletions follow secure data-destruction procedures.
