SEL DEVELO, Inc. (“SEL DEVELO,” “we,” “our,” or “us”) is a United States–based company that provides educational technology services primarily for use by schools, educators, and students within the United States. While our Services are designed for U.S. institutions and are governed by U.S. laws such as FERPA, COPPA, and applicable state student privacy regulations, individuals in the European Economic Area (“EEA”), the United Kingdom (“UK”), or other jurisdictions subject to the General Data Protection Regulation (“GDPR”) may access our website or materials. This GDPR Statement outlines SEL DEVELO’s general approach to data protection in circumstances where the GDPR or UK GDPR may apply.

SEL DEVELO is committed to the principles of lawful, fair, and transparent processing. When the GDPR applies, personal data is collected and processed only for specific and legitimate purposes, is limited to what is necessary for the operation of the Services, and is retained only for as long as required to fulfill those purposes. SEL DEVELO employs appropriate technical and organizational measures to safeguard personal data, including protections against accidental loss, unauthorized access, misuse, or unlawful processing. SEL DEVELO does not sell personal data or use personal data for third-party targeted advertising.

SEL DEVELO does not actively market or direct its Services toward schools located in the EEA or UK. However, if SEL DEVELO intentionally enters into a relationship with an EEA or UK institution, we will do so under appropriate lawful bases for processing and implement required safeguards. These may include Standard Contractual Clauses (“SCCs”) or other legally recognized transfer mechanisms for the transfer of personal data from the EEA or UK to the United States. Most data processing performed by SEL DEVELO occurs exclusively in the United States, and the platform is architected for compliance with U.S. K–12 privacy frameworks rather than GDPR as a primary regulatory regime.

Where GDPR applies, SEL DEVELO may rely on several legal bases for processing, including the performance of a contract when providing Services to an educational institution, compliance with legal obligations, legitimate interests in maintaining, securing, and improving the Services, and, where appropriate, consent for optional features such as marketing communications. When our Services are used in an educational setting within the EEA or UK, the educational institution is responsible for determining the appropriate lawful basis for processing student personal data and for obtaining parental consent where required under Articles 6 and 8 of the GDPR. SEL DEVELO processes student information solely on behalf of and under the direction of the educational institution.

Individuals located in the EEA or UK may have certain rights with respect to their personal data, including rights of access, rectification, erasure, restriction, objection, and portability, as well as the right to withdraw consent where consent is the applicable lawful basis. Requests may be sent to privacy@seldevelo.com. Because SEL DEVELO provides its Services to educational institutions acting as data controllers, some requests may need to be addressed directly to the institution rather than SEL DEVELO, and certain rights may be limited by U.S. educational privacy laws or contractual constraints.
